Terms of Service

Acceptance

These Terms, our Privacy Policy, Community Guidelines, and Safety Guidelines together form the rules for using Verdict.

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date or notifying you in the app. Continued use after changes means you accept the updated Terms.

Eligibility

You must be at least 13 years old to use the Service.

If you are under 18, you represent that a parent or legal guardian has reviewed these Terms and permits your use.

Your Account

You are responsible for activity on your account and for keeping your sign-in method secure.

Provide accurate information. Do not impersonate others or create accounts for someone else without permission.

You may not sell or transfer your account.

Missions and Real-World Participation

Verdict publishes daily real-world missions. Participation is voluntary. You choose whether to accept or complete a mission.

You are responsible for your own conduct. Do not complete missions in unsafe situations, while driving, while trespassing, or in any way that breaks applicable law.

Mission text is guidance only. Use common sense and follow our Safety Guidelines.

User Content and Proof Photos

Photos and other material you submit ("User Content") remain yours. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display User Content within the Service, including on The Wall and in your archive, so we can operate Verdict as described in our Privacy Policy.

You represent that you have the rights to submit User Content, that it is yours (or you have permission), and that it follows our Community Guidelines.

We may remove User Content that violates these Terms or our policies.

Featuring Your Proof Outside the Service

The licence above is limited to operating the Service. We do not use your User Content in marketing, advertising, or promotion unless you separately turn on "Feature my proof" in Settings under Privacy. That setting is off by default and nothing is used while it is off.

If you turn it on, you grant us an additional worldwide, non-exclusive, royalty-free licence to reproduce, display, and distribute your User Content, the mission it answers, and your username on our websites, app store listings, social accounts, and advertising. This applies to User Content you submitted before turning the setting on as well as afterwards. We do not sell your User Content and we do not sublicense it to third parties for their own marketing.

You can turn the setting off at any time. We will stop using your User Content in new material. Material already published, printed, or scheduled may take a reasonable period to withdraw, and we cannot recall copies already distributed.

Turning the setting on covers your own consent only. It does not grant permission on behalf of anyone else appearing in your User Content. We review User Content before featuring it and will not feature content showing an identifiable person who has not agreed.

Prohibited Conduct

You may not use the Service to break the law, harm others, harass or threaten users, submit non-consensual or sexual content, promote hate or violence, impersonate others, spam, scrape or reverse engineer the Service, or interfere with its operation.

Moderation and Enforcement

We have zero tolerance for objectionable content and abusive users. Every proof can be reported in the app and every user can be blocked. We act on reports of objectionable content within 24 hours by removing the content and ejecting the user who provided it.

We may review reports, remove content, warn users, suspend accounts, or permanently ban accounts that violate these Terms or our policies.

We are not obligated to monitor all content but may act at our discretion, including for severe violations such as threats, exploitation, or illegal content.

Availability

We strive to keep the Service running but do not guarantee uninterrupted access, specific mission availability, or any particular feature at all times.

We may change, pause, or discontinue parts of the Service.

Intellectual Property

The Verdict name, branding, app design, mission copy (where not user-submitted), and underlying software are owned by Verdict or its licensors. These Terms do not grant you rights to our trademarks except as needed to use the Service.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

REAL-WORLD MISSIONS INVOLVE RISK. YOU ASSUME ALL RISK OF INJURY, LOSS, OR DAMAGE FROM YOUR PARTICIPATION. VERDICT IS NOT RESPONSIBLE FOR YOUR ACTIONS OR OUTCOMES WHILE COMPLETING MISSIONS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERDICT AND THOSE WHO WORK WITH US WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (TYPICALLY ZERO FOR FREE USE). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM PERMITTED BY LAW.

Termination

You may stop using the Service at any time and may request account deletion in the app (Settings > Account Management) or on our Delete Account page.

Partial data deletion (without closing your account) is available in the app and on the Delete Account page.

We may suspend or terminate your access for violations of these Terms or for operational reasons.

Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria for any dispute arising under these Terms.

Nothing in these Terms limits any non-excludable rights you have under the Australian Consumer Law or any other applicable mandatory consumer protection legislation.

App Store Terms

These Terms are between you and Mode Labs. Apple Inc. and Google LLC are not parties to these Terms and are not responsible for the Service or its content.

Apple Inc. and Google LLC have no obligation to provide maintenance, support, updates, or other services for the Service.

If you downloaded the iOS app from the Apple App Store, Apple Inc. is a third-party beneficiary of these Terms and has the right to enforce them against you as a third-party beneficiary.

If you downloaded the Android app from Google Play, Google Play's terms of service also apply to your use of the Service.
